Facing an avalanche of grassroots pressure, and political pressure from New Jersey’s Governor Chris Christie, the Atlantic County prosecutor has announced that Shaneen Allen won’t face up to five years in prison for carrying her concealed carry piece into New Jersey.
Allen’s case had become a cause célèbre among the gun rights community – even appearing on the cover of the National Rifle Association’s American Rifleman magazine. Gun owners pointed to the inconsistency in the prosecution of a law-abiding woman with a concealed carry license being threatened with us to a mandatory three plus years in prison for honesty, while NFL star Ray Rice being given pre-trial intervention for knocking his wife out cold in an elevator.
The Philadelphia Enquirer reports today:
After a review by the state attorney general, the Atlantic County Prosecutor’s Office announced Wednesday that it would allow a Philadelphia woman charged last year with illegally bringing into New Jersey a gun that was legally registered in Pennsylvania to enter a pretrial-intervention program and avoid jail time.
The prosecutor’s previous stance in the case involving Shaneen Allen, 27, was to make the case a “deterrent,” either forcing a plea or bringing it to trial. The mother of two could have faced up to five years in prison.
Allen, who was stopped for a routine traffic violation on the Atlantic City Expressway, was arrested after voluntarily telling a state trooper that her purse contained a legally registered .38-caliber Bersa Thunder handgun.
How will this affect her permit? She now has an arrest record for a weapons charge! Dropped or not, the arrest record doesn’t go away. A may issue state might not issue. Will PA reenstate her permit? Will a job overlook the arrest? Sure, I know, can’t hold it against her right? And yet here we are, defending a woman who shouldn’t have been arrested, in possession of a permission slip she shouldn’t need thanks to our 2nd Amendment! This isn’t a win! She shouldn’t have to do some stupid diversion program! This is the boiling frog folks! CCW permits should be eliminated! We don’t need permission to execute a right! Think about it, we scream about gun registration right! If you have a CCW, you ARE registred! When they decide to execute a confiscation, where do you think they will start! If they raid your house with the SWAT team, registered guns or not, they will find/take them. Resist, and your house (to include your body) will look like swiss cheese. This DA and all the liberal, anti freedom and anti gun individuals are Rats! How do you deal with Rats? You exterminate them! Stop being SHEEP!

Don’t get me wrong. This is good news for her. I would not wish the grief of dealing with this on anyone. But…. If she was prosecuted, could this case have been one to take to SCOTUS – forcing national reciprocity?

They need to get a new prosecutor and some new cops, it’s obvious this lady isn’t a criminal but that didn’t stop them from going after her anyway.
One disturbing aspect of this whole affair is that it seems a majority of police officers would have arrested her. Even the eminent Mas Ayoob admits he probably would have arrested her. A person in a position of authority who knows an action is wrong, but does it anyway, deserves condemnation.

The law is the law, as much as we may not like it. It’s one of the reason why we need to vote in politicians who are symphathethic to the cause. Changing an unjust law thru legal means is easier than simply not following it. Permanent changes are better than stopgaps, and we aren’t hoodlums.
