Federal District Court strikes DC’s handgun ban

Concludes a blanket ban of carry of handguns outside the home cannot survive ANY level of scrutiny, and is therefore unconstitutional.

In light of Heller, McDonald, and their progeny, there is no longer any basis on which this Court can conclude that the District of Columbia’s total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny. Therefore, the Court finds that the District of Columbia’s complete ban on the carrying of handguns in public is unconstitutional.

Prepare yourself for the caterwauling from the other side, proclaiming that there will be blood in the streets now that their gun control laws have been struck down.  The only problem is that their gun control is what has caused much of the blood in the streets by disarming good guys and emboldening the bad guys.

This is huge, folks.

Don’t expect the liberty-eschewing gun haters to quit their campaign to disarm us all though.  There’s too much money from Bloomberg, Soros, et al to just end their Quixotic quest.

They’ll try to enact as many restrictions as they can, despite a clear legal smack-down.

  1. There was already blood in the streets from gang bangers shooting AT each other but hitting those not /directly/ involved. But blood will not flow from the innocent by means of law abiding citizens carrying for protection for themselves and their loved ones.

  2. This is an awesome and surprisingly correct decision bybthe court.

    Our government is less and less willing to follow the law. What do you think the over and under will be on how long it will take for DC to completely jump the tracks on this and simply ignore the law and courts?
