President B. Hussein Obama’s trickle of executive orders on guns are nothing more than a farce.  It’s more symbolism over substance.  We’ll get into them in a moment, but in a nutshell, they are simply word games and proposals.

Obama’s earmarked only $4 million towards enforcement.  That’s significantly less than the government spent to encourage kids to dress up as fruits and vegetables to promote healthier eating.

Word games as they are, they are still concerning as the Obama regime attempts to redefine “dealer” down to someone who sells as few as ONE firearm per year.

Here’s the text from the White House’s website:

Clarify that it doesn’t matter where you conduct your business—from a store, at gun shows, or over the Internet: If you’re in the business of selling firearms, you must get a license and conduct background checks. Background checks have been shown to keep guns out of the wrong hands, but too many gun sales—particularly online and at gun shows—occur without basic background checks. Today, the Administration took action to ensure that anyone who is “engaged in the business” of selling firearms is licensed and conducts background checks on their customers. Consistent with court rulings on this issue, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has clarified the following principles:

  • …Quantity and frequency of sales are relevant indicators. There is no specific threshold number of firearms purchased or sold that triggers the licensure requirement. But it is important to note that even a few transactions, when combined with other evidence, can be sufficient to establish that a person is “engaged in the business.” For example, courts have upheld convictions for dealing without a license when as few as two firearms were sold or when only one or two transactions took place, when other factors also were present.

In fact, let’s look at the high points of his actions, an our take:

1. Keep guns out of the wrong hands through background checks.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is making clear that it doesn’t matter where you conduct your business—from a store, at gun shows, or over the Internet: If you’re in the business of selling firearms, you must get a license and conduct background checks.

We already do that.

ATF is finalizing a rule to require background checks for people trying to buy some of the most dangerous weapons and other items through a trust, corporation, or other legal entity.

That’s going to be a giant pain in the butt to further investigate each member of a trust each time there’s an acquisition.  If only the government paid as much attention to bad guys.  The good news is the ATF just announced they were eliminating the “Chief Law Enforcement Official” sign-off for National Firearms Act paperwork.  Frankly, I looked to see if it was April 1st today when I saw that aspect of the announcement.

Attorney General Loretta E. Lynch has sent a letter to States highlighting the importance of receiving complete criminal history.

The Federal Bureau of Investigation (FBI) is overhauling the background check system to make it more effective and efficient. The envisioned improvements include processing background checks 24 hours a day, 7 days a week, and improving notification of local authorities when certain prohibited persons unlawfully attempt to buy a gun. The FBI will hire more than 230 additional examiners and other staff to help process these background checks.

I’ve envisioned myself winning the $300,000,000 Powerball lottery a few times up to last week’s drawings, but that never happened.

2. Make our communities safer from gun violence.

The Attorney General convened a call with U.S. Attorneys around the country to direct federal prosecutors to continue to focus on smart and effective enforcement of our gun laws.

The President’s FY2017 budget will include funding for 200 new ATF agents and investigators to help enforce our gun laws.

Our nation has not run on a passed budget for how many years now under President Stompy Feet?

ATF has established an Internet Investigation Center to track illegal online firearms trafficking and is dedicating $4 million and additional personnel to enhance the National Integrated Ballistics Information Network.

The government spent $5 to have kids dress up as fruit and vegetables, supposedly to promote healthier eating.  Are you saying that solving gun violence is less important than a silly program to dress kids up as peas and carrots?

ATF is finalizing a rule to ensure that dealers who ship firearms notify law enforcement if their guns are lost or stolen in transit.

Isn’t that the norm?  The question is:  will this order include the ATF walking guns to the Mexican drug cartels?

The Attorney General issued a memo encouraging every U.S. Attorney’s Office to renew domestic violence outreach efforts.

“Encouraging”.  Yeah, I’m encouraging my wife to buy a winning Powerball ticket for Wednesday’s $400M drawing.

3. Increase mental health treatment and reporting to the background check system.

The Administration is proposing a new $500 million investment to increase access to mental health care.

Wendy, dear:  I’m proposing that we buy a new car for each of us after you buy that winning Powerball ticket tonight, okay?

The Social Security Administration has indicated that it will begin the rulemaking process to include information in the background check system about beneficiaries who are prohibited from possessing a firearm for mental health reasons.

The Department of Health and Human Services is finalizing a rule to remove unnecessary legal barriers preventing States from reporting relevant information about people prohibited from possessing a gun for specific mental health reasons.

4. Shape the future of gun safety technology.

The President has directed the Departments of Defense, Justice, and Homeland Security to conduct or sponsor research into gun safety technology.

The President has also directed the departments to review the availability of smart gun technology on a regular basis, and to explore potential ways to further its use and development to more broadly improve gun safety.

“Smart Gun” technology has been an utter failure.  We have to ask, is the smart technology he wants anything like the “smart diplomacy” he has given us in America’s foreign policy?  

Congress should support the President’s request for resources for 200 new ATF agents and investigators to help enforce our gun laws, as well as a new $500 million investment to address mental health issues.

It’s official:  I’m announcing a request that Barack Obama resign, effective today.  While I think investing in mental health treatment is a good thing, I am skeptical it’s going to happen even in federal budgets that are a trillion dollars in the red each year under Obama.

Because we all must do our part to keep our communities safe, the Administration is also calling on States and local governments to do all they can to keep guns out of the wrong hands and reduce gun violence. It is also calling on private-sector leaders to follow the lead of other businesses that have taken voluntary steps to make it harder for dangerous individuals to get their hands on a gun. In the coming weeks, the Administration will engage with manufacturers, retailers, and other private-sector leaders to explore what more they can do.

Who wants to see our communities more dangerous, our children less safe other than race baiters and gun grabbers?

There’s a lot more of the same at the White House website (see link above), but it’s just more bloviating.  Once again, Team Obama talks.

The only problem is that unlike when E.F. Hutton talks, when Obama talks, nobody except the mainstream media and low-information voters listens.

  1. If we indeed lose the CLEO sign-off requirement, then I’m not too upset over this round of Executive Orders. Yes, we’ll have to see what they come up with for reinterpreting being “engaged in the business” of selling guns, but I doubt it’ll be a great change from what we have now. Selling guns I don’t use anymore to make room in my safe is not likely going to qualify me as “engaged in the business.”

    The CLEO thing will be awesome though. I already have a Form 1 pending with the ATF. It took 3 months of convincing before my CLEO signed it. All in all it was a pain. But If this changes then I’m submitting several more!

    As for “smart gun” technology, the gun grabbers have nobody to blame but themselves for that failure. They poisoned the well when states started putting in mandates that once the technology became available then only “smart guns” would be legal within their borders. Had it not been for this mandate then perhaps we’d already have smart guns available. Heck, maybe law enforcement would be using them too. Who knows? I think they’d be a gimmick and likely not widely adopted, but we don’t know because the mandate killed the technology before it had any chance.

  3. I just listen to part of President Stompy Feet.
    I purchased a firearm via the internet for Christmas to myself.
    I had to have it shipped and go fill out the Federal back round check. How can you buy one without that. I even had to comply with Illinois waiting period.
    How did Missouri cancel the back round checks?
    Was that another of the lies he just told all of us?

  4. Not sure how you can buy a firearm legally over the internet (as in not in-person) without an FFL receiving the firearm as an in-transfer, and then doing a background check, waiting period, etc.
    Ways for an unlicensed person to buy over the net:
    1. You are unlicensed, and buy a firearm over the net from a licensed FFL (say J&G Sales) and have it sent (transferred) to a licensed FFL you select. You go to the receiving FFL and get a background check, waiting period, etc. Currently LEGAL. Enjoy your gun.
    2. You are unlicensed, and buy a firearm from an unlicensed person over the net, he sends it to an licensed FFL you select who will accept the transfer. You go to the receiving FFL and get a background check, waiting period, etc. Currently LEGAL. Enjoy your gun.
    3. You are unlicensed, and you buy from an unlicensed person (Mr. Craigslist) over the net , and he sends it to directly you – Oops, currently ILLEGAL. The Internet Loophole! Sender and Receiver could get to enjoy some jail time and become serial-numbered felons for this practice, but you gotta catch-em first. With no FFL in the receiving line, this practice is illegal already, what does the new crap fix here? Is this a new double secret illegal? Two people can still do the illegal dance if they wish, to heck with the new stompy foot ordinance, but you still gotta catch-em.

    1. Isn’t option 3 only illegal if the buyer and seller are in different states? If the two are in the same state then it is legal for a non-ffl to ship to another non-ffl.

      The only thing that might trip this up is the whole not knowingly selling a gun to a criminal thing. Since you can’t really know anyone’s identity off the internet, shipping blindly like that would be really foolish.

    2. Matt. Yes, transfers between unlicensed individuals that go state-to-state is the big illegal. This is a portion of what the Illinois State Police have on their website on transfers instate between unlicensed individuals: “Any person within this State who transfers or causes to be transferred any firearm, stun gun, or taser shall keep a record of such transfer for a period of 10 years from the date of transfer. Such record shall contain the date of the transfer; the description, serial number or other information identifying the firearm, stun gun, or taser if no serial number is available….”. Also now the instate seller has to contact the ISP with the instate Buyer’s Foid to get a back ground check approval number to include in the record of the transfer. And on and on thru the rules. Maybe that’s why criminals steal them – almost seems easier.
      As you say sending guns is also a possible trip-up whether you are sending handguns, or long guns. Check the carrier rules, they may have special requirements on what you can and can’t do.

    I think I’ll “encourage” Mrs. W. to go out and buy us a Powerball Ticket.

    I’ll just tell her I “envision” us winning.

  7. These EO must be repealed immediately.

    This isn’t an issue of All HAT and No Cattle this is an issue of opening up doors for further ENCROACHMENT UPON OUR RIGHT TO KEEP AND BEAR ARMS!

    This claim you need an FFL just to sell one firearm based on the ATF interpretation of whether or not its a violation of Obama’s EO is total BS!

    These types of rulings are selectively enforced for political reasons. this is something that Aaron Zelman warned us about at JPFO for years.

    Do any of really believe that if these EO are allowed to stand that they wont be fully funded in the future?

    This is why I criticize the NRA for their support of the 68 GCA. Its a law that should have never been allowed to occur. It opened the door to further gun control measures.
