Senator Julie A. Morrison wants to play “gotcha” games with your gun rights.

When you apply for a new FOID card in Illinois, as soon as the Illinois State Police gets your application, they invalidate your old one while they process the renewal.  How do we know?  Because people, myself included, have tried to buy a gun after submitting the renewal form, only to be “denied” on the purchase because of an “invalid” FOID card.

It’s usually cleared up within a week or two, but it’s annoying, and frankly, it’s unnecessary.

Today, when you apply for your Illinois concealed carry license, they invalidate your FOID card while they complete the processing so they can send you a brand new FOID card along with your Illinois Concealed Carry license.

New legislation has been introduced in the Illinois Senate by Democrat Senator Julie A. Morrison (SB-0549, Amendment 1).  The proposal encourages prosecution of that “technical” violation of the law by sending notice of the “violation” to states attorneys in the locations involved, along with the US Attorney’s office.

It’s nothing more than an effort to facilitate prosecution in scenarios like I described above.

Frankly, it’s a waste of everyone’s time, but it makes for “good” lawmaking for those political hacks who would deprive you and I of the right to keep and bear arms.

SB 0549 (SFA 0001)
Replaces everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Provides that if the Department of State Police determines, based on information obtained under the dial up system or from a seller contacting the Department of State Police in a private sale to determine the validity of the attempted purchaser’s FOID Card, that a person attempting to purchase a firearm or applying for a Firearm Owner’s Identification Card is disqualified from possessing a firearm under State or federal law, the Department of State Police shall send notification of denial to all local law enforcement agencies, State’s Attorneys, and United States Attorneys who have jurisdiction over either: (1) the area where the attempted purchase occurred; or (2) the area where the attempted purchaser or applicant resides. Provides that the notification shall include the identity of the attempted purchaser or applicant, the date and time of the denial, the grounds for the denial, and the location where the attempted purchase or application was made. Provides for the submission of annual written reports to the Department of State Police by local law enforcement agencies and State’s Attorneys who receive the notifications. Provides that the Department of State Police shall publish a written report, on an annual basis, including the following information: (1) the number of denials of firearm transfers; (2) the number of denials of applications for Firearm Owner’s Identification Cards; (3) the number of notifications of denial made to State law enforcement agencies, local law enforcement agencies, State’s Attorneys, and United States Attorneys; (4) if notification was not made for any denials, an explanation of why the notification was not made; (5) the number of investigations opened, the number of investigations concluded, and the number of referrals for prosecution; (6) the number of investigations opened, by grounds for denial; (7) the number of referrals for prosecution, by grounds for denial; (8) the number of charges arising from denials, by type of charge and grounds for denial; and (9) the disposition of all these charges, by type of charge and grounds for denial.

  1. When did they start sending a new FOID with the concealed license, and why? I didn’t get one two years ago with mine.

  2. When I lived in Illinois, a valid FOID card was required to purchase a gun or ammo, but a “previously issued” FOID card was required to possess them. In other words, if you let your FOID card expire, you couldn’t buy anything, but anything you already owned was still legal. (This presumes, of course, that your FOID card was not voided upon your becoming a prohibited person.)
    But in the wake of Heller and McDonald, why is requiring a FOID card legal at all? Requiring a license to exercise a right is the ultimate infringement of that right. I don’t need a license to exercise free speech here (yet), and if I’m ever charged with a crime, I don’t need a license to exercise my right not to incriminate myself (because I’m not a Baltimore cop).
    I’m just so confused.

  3. Invalidating someone’s FOID card without due process? There should have been a law suit about this long ago.

  4. Until the NRA, its members or any other 2nd Amendment American is ready to do what is needed to stop these tyrannical leftist, we will continue to circle jerk in this system. My question is, what is Trump or Cruz going to do about it. Will they institute constitutional carry across the nation and do away with permission slips all together? Why hasn’t the NRA pressed them on what they would do as President for law abiding gun owners? I get letters every other week from the NRA requesting more of my money. I am tired of hearing the same old rhetoric from them. Instead, every time I get one of those letters, I use the money I would have sent them to go buy ammo. My stock is growing fast. These leftist will not stop until they turn America into Australia or Europe. Are we going to just continue to bitch about this or will the day come where we have the guts to fight, like our founding fathers did?! Do we have the constitution within ourselves to do what must be done. Next time you look in the mirror, ask yourself that. I know my answer. I have answered that question many times. The answer never changes. Some times, there are battles/wars, you just can’t fight alone. It’s time to get off the couch or chair, break free of the keyboard and do what is needed to save out freedoms here at home. We are one generation or less away from losing it all. You don’t have to look far from your zip code or state line to see it already happening. Anyone who lives on the east coast, CA or Chicago should be able to tell you that!   5. We had republicans (note case of “r”) in control of both Congress and the White House under Bush for a time. What did we get as gun owners? Nothing.

    While I hope CheaTED Cruz or Donald Trump win the presidency, I’m skeptical the Mitch McConnells and the Paul Ryans of the RINO world will give us meaningful gun laws.

    It’ll be up to us to continue to elect real conservatives that support gun rights before things will change. Unless it gets so bad that it’s time to start voting with the cartridge box from the rooftops…

    I can’t imagine my local SA’s office charging a FOID holder or a CCW applicant for a denied sale because the ISP invalidates an old FOID card before issuing the new one. I can’t say I have that same confidence if I were to buy a gun in Cook County and get tripped up in this.

  6. Yeah, Anita Alvarez will let someone who tries to kill someone off with a misdemeanor, but if your FOID card is invalid as ISP processes the new one, she’d want prison time, I guarantee it.

    I keep telling you guys to start working for repeal or reform of the FOID card law because its going to BITE ALL of us in the arse.

    Oh but I’m a dirty absolutist, and people like me will never win! No legislation that I would ever support would pass in the General Assembly.

    Start working on repeal or reform while you still can. The first step must be to start the education process by encouraging people to push for repeal or reform. Have legislation introduced to chip away at the current law.

    1. There is a movement afoot to repeal the****-ing FOID card. I saw it on Facebook. If you don’t go on Facebook, I imagine if you Googled “repeal the FOID” it might lead you to the site.

  8. The only way to get rid of career politicians is with a convention of states, once there we could impose term limits and Constitutional carry. It takes a super majority (34 states)to change anything in the Constitution but I imagine that there’s enough pissed off, like minded people running around to get the job done. Article 5 of the Constitution. Think of our forefathers, it’s an action they took.

    1. Incorrect. To change the Constitution requires a three fourths majority, or 38 states. To propose it requires fewer, but to approve it is 38.

    2. It will take 34 states to call for the convention but (you are correct) it will take 38 to pass something.

    4. According to Conservative Review there are currently 37 states working on it and 4 states have already signed on. I wonder what we need to do in Illinois to change our state constitution. I’m damned tired of living in Madiganistan.
