The trial in the consolidated lawsuits challenging Gov. Pritzker’s precious gun and magazine ban continues apace in federal court in the Southern District of Illinois.  It’s progressing about as we expected it would, with the possible exception that it might wrap up today – or about a day earlier than we anticipated.

Don’t get wrapped up in the “he said – she said” BS of the trial.  Most of the “expert” stuff is to satisfy the Seventh Circuit Court of Appeal’s made-up “Kissin’ Cousins Test.”  That, in a nutshell as they articulated it last October when they ruled against us at the preliminary injunction state of the trial, was that if it kinda-sorta looks like a military gun the government can regulate it – up to an including banning it.

Nevermind that the Seventh’s new “Kissin’ Cousins Test” runs afoul of both Heller and Bruen.

(The Center Square) – Attorneys for the state of Illinois called their first witness to the stand in the trial against the state’s gun and magazine ban.

Illinois banned the sale and possession of more than 170 semi-automatic firearms and magazines over certain capacities in January 2023. Lawsuits in federal court went all the way to the U.S. Supreme Court on preliminary grounds, but was kicked back to the district court for final action.

All week in East St. Louis, litigants have been in the courtroom of Judge Stephen McGlynn arguing the case on final judgment…

The bench trial continues and is expected to wrap up in East St. Louis Thursday.
