The Illinois Legislative Democrats are going all-in on gun confiscation. They’ve employed the “gut and replace” move to change a water supply bill into a gun confiscation bill. What would it do? It requires law enforcement to SEIZE guns and ammunition from those who are named in Red Flag orders as well as more traditional orders of protection.
What’s that mean? It means if you’re in a divorce you can expect to get hit with the police showing up at your house to seize your stuff unannounced.
Yes, people are going to die – both cops and gun owners. Because some gun owners aren’t going to allow government to seize their guns without due process. And yes, our current system allows your guns to be taken WITHOUT DUE PROCESS. Sure, you get a court hearing in 10 days to prove your innocence – at your expense, of course – and even if the original order was thrown out as unfounded, then you have to fight to get your stuff back after the Illinois State Police get around to restoring your FOID card (and maybe your CCW as well) in a few months.
Of course, there’s no provisions for sanctioning those filing frivolous Red Flag motions as part of the de rigueur part of divorce negotiations and child custody fights.
The (new) bill number is HB-4144.
It passed the Senate yesterday. It’s on the concurrence list for the House. It’ll be passed into law today/tonight. The governor will sign it into law. Don’t waste your time calling, filing witness slips. This is a done deal. Direct your life energy to something more constructive (like looking for a new place to live out of this God-forsaken hellhole).
What can you do in the meantime? Don’t keep all your eggs in the same basket.

Time to put in a “red flag” complaint for any and all legislators that create, signed onto, or support this malfeasant of legislation, just sayin’.
My thought exactly as I was reading it. Since there is no penalty for frivolous red flag motions, give them a taste of their own medicine. More than likely though, the ISP would exempt them from these things.

You can blame Democrats all you want for this and thank the Republicans that voted NO. At the end of the day, police will carry out these raids and confiscations. Not the Democrats voting for this bill. Pritzker isn’t knocking on your door. The police will be the ones busting in with their weapons pointed at YOUR head in YOUR house. Who will the Republicans give deference to? THE POLICE. When you “Back the Blue” this is what you sign up for: the needs, wishes and feelings of the cops supersede that of the citizens. Who are the police? The government. Sorry to disappoint anyone living with blinders on but it is what it is and some of us are willing to call a spade a spade.
